Dali Wireless Files Second Patent Infringement Lawsuit Against Corning; Broadens Scope to Include Optical Network Evolution (ONE) Products

Dali Wireless, Inc. a world-wide innovator in digital radio distribution systems and digital predistortion technologies today announced it has filed a second lawsuit against Corning Optical Communications LLC in the United States District Court for the Western District of Texas, Waco Division. In its complaint, Dali alleges that Corning incorporated Dali’s innovations into its ONE and SpiderCloud products, thereby infringing on U.S. Patent Nos. 9,826,508, and 9,769,766 (Case No. 6:20-cv-00827). Dali has petitioned the court for monetary damages.

This complaint in Waco, Texas comes on the heels of an amended lawsuit filed in December against Corning Optical Communications LLC, alleging infringement of U.S. Patent Nos. 10,433,261, 9,197,358, and 10,506,454 (Case No. 3:19- cv-714). In that first case, Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of Corning’s SpiderCloud E-RAN System. This second lawsuit broadens the scope to include Corning ONE products.

In addition to the two noted Corning suits, Dali has also filed suit against John Mezzalingua Associates, LLC d/b/a JMA Wireless alleging infringement of US Patent Nos. 10,334,499, and 9,820,171 (Case No. 1:19-cv-02367) and CommScope Technologies LLC and CommScope Holding Company, Inc. alleging infringement of U.S. Patent Nos. 10,045,314, 10,080,178, 9,847,816 and 8,682,338 (Case No. 1:19-cv-00952-MN).

Earlier this year, Dali received a favorable final decision from the United States District Court for the Northern District of Texas in Dallas against CommScope (Case No. 3:16-cv-00477). The chief judge upheld the jury’s decision to award Dali $9.5 million in past damages. This final decision from the court upholds the validity of Dali Wireless’ patents.
