TRUSTID, Inc., a Neustar company, has been awarded a new U.S. patent and has prevailed in a series of patent-related legal actions — significant victories for TRUSTID as it seeks to protect and enforce its intellectual property rights.

TRUSTID is the leader in pre-answer caller authentication services and has established a significant patent portfolio around its innovative technology, dating back to 2009. Recently, TRUSTID sought to assert these patents and has received several favorable decisions in support of its intellectual property.

On Aug. 20, 2019, TRUSTID was awarded another patent, U.S. Patent No. 10,389,872, related to using calling party number for caller authentication. This patent augments TRUSTID’s existing patent portfolio and strengthens its ability to protect the innovative intellectual property behind its industry-leading caller authentication technology.

The patent award follows on the heels of multiple recent wins for TRUSTID with respect to its intellectual property.

In October 2019, the U.S. District Court for the District of Colorado denied several motions filed by defendant Next Caller in an action initiated by TRUSTID in April. TRUSTID alleged trade-secret misappropriation, tortious interference with business relations, and breach of contract. The court’s decisions were as follows:

(1) denied the defendant’s motion to dismiss; and

(2) denied the defendant’s motion for an award of costs, including attorneys’ fees.

“We are gratified to see these motions dismissed,” said Patrick Cox, senior vice president at Neustar and general manager of TRUSTID. “We are pleased with the success of our enforcement efforts to date and look forward to an ultimate finding in our favor.”

More importantly, TRUSTID has won significant victories in a related lawsuit filed in January 2018 against Next Caller in the U.S. District Court for the District of Delaware. TRUSTID alleged false advertising and infringement of three of its patents (U.S. Patent Nos. 9,001,985; 8,238,532; and 9,871,913). The Delaware court issued the following decisions:

(1) denied the defendant’s attempt to dismiss the patent infringement claims and invalidate the patents as not being drawn to patentable subject matter;

(2) denied the defendant’s motion to dismiss the false advertising claims; and

(3) adopted TRUSTID’s proposed definition for the only disputed term in the case.

Attempts to invalidate TRUSTID’s patents by Next Caller at the Patent Trial and Appeal Board (PTAB) have also failed. Specifically, in October 2019, the PTAB denied institution of two inter partes reviews (IPRs) filed against the ’532 patent and one IPR filed against the ’913 patent.

Neustar — a market leader in fraud, risk and compliance — acquired TRUSTID in January 2019 for its market leading solutions and patent portfolio, and it seeks to vigorously defend that portfolio.

“These wins show the significant strength of and momentum behind the TRUSTID intellectual property enforcement efforts,” said Kevin Hughes, Neustar’s general counsel. “TRUSTID invested significant amounts of time and money to make innovative network improvements that restore trust in calling party number information and enable the best caller authentication technology available. Having recently acquired TRUSTID, Neustar fully supports these actions to defend the company’s intellectual property rights.”
